5. Agent Deployment and Data Collection
5.1 Deployment Authorization
You certify that you have proper authorization to deploy AMOSKYS agents on all devices where they are installed. You are solely responsible for ensuring compliance with applicable laws and organizational policies.
5.2 Data Collection
Agents collect system telemetry including process information, network activity, file integrity data, and performance metrics. All data is encrypted in transit and at rest.
6. Intellectual Property
AMOSKYS and all related trademarks, service marks, logos, and intellectual property are owned by Akash Thanneeru and/or AMOSKYS. You may not use our intellectual property without prior written permission.
Your telemetry data remains yours. We only use it to provide our service and improve threat detection.
7. Service Level and Availability
While we strive for 99.9% uptime, we do not guarantee uninterrupted service. The Platform may be temporarily unavailable due to maintenance, updates, or unforeseen circumstances.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- AMOSKYS is provided "AS IS" without warranties of any kind
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount you paid in the last 12 months
- We are not responsible for security breaches that occur despite our service
Important: AMOSKYS is a security monitoring tool, not a guarantee of security. You remain responsible for your organization's overall security posture.
9. Indemnification
You agree to indemnify and hold AMOSKYS harmless from any claims, damages, or expenses arising from:
- Your use of the Platform
- Unauthorized agent deployments
- Violation of these Terms
- Infringement of third-party rights
10. Data Retention and Deletion
We retain telemetry data for 90 days by default. You may request data deletion at any time by contacting us. Upon account termination, all data is deleted within 30 days.
11. Compliance and Export
You agree to comply with all applicable laws, including export control regulations. AMOSKYS agents and encryption technology may be subject to U.S. export controls.
12. Modifications to Terms
We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance. We will notify users of significant changes via email.
13. Governing Law
These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the United States.
